Our Privacy Policy is an integral part of these Terms. Please read both of these documents carefully, and do not use our Service if you do not agree with any of the provisions contained herein.

Interpretation
Words with initial capitalization in these conditions carry specific definitions. These definitions remain consistent, whether the words are used in the singular or plural form.
Definitions
In these Terms and Conditions, the following terms have the following meanings:
"App" means the AnyHouse Rentals mobile application, available through the Apple App Store and the Google Play Store.
"Bot" means AnyHouse chatbot, hosted in Telegram.
"Feedback" means ideas, feedback, or innovations that are provided by You regarding the improvements of our Service.
"Service Provider" (or "the Service Provider," "We," "Us," "Our") refers to AnyHouse NL, registered in the Netherlands under Chamber of Commerce (KVK) number 93038151.
"Services" means all the features offered to the User through the Website, App, and Bot.
"Subscription" refers to the services or access to the Service offered on a subscription basis by the Service Provider to You.
"Telegram" refers to the Telegram messenger, available from https://telegram.org or their mobile application.
"Terms and Conditions" (or "Terms," "TOS") mean these Terms and Conditions that form the entire agreement between You and the Service Provider regarding the use of the Service.
"Users" collectively refer to all individuals, companies, or other legal entities accessing or using the Service, as described in the singular term "User."
"Website" refers to the AnyHouse website, accessible from https://anyhouse.me.
"You" (or "User") refers to the individual who accesses or uses the Service, or to the Service Provider or other legal entity on whose behalf the individual is accessing or using the Service, as applicable.
Description of the Service
Our Service is designed to assist Users in locating rental properties. The Service aids Users in identifying suitable rental properties by filtering property advertisements sourced from various internet platforms and delivering personalized notifications. Users possess the ability to configure their filters and criteria within the App or Bot.
The Service is accessible through:
- The AnyHouse Rentals mobile application
- The AnyHouse Telegram Bot
- Our Website at https://anyhouse.me
Eligibility
You must be at least 18 years old to create an account or otherwise use the Service. By using the Service you confirm that you meet this requirement. We may suspend or terminate any account that we believe belongs to a person under 18.
Subscriptions (AnyHouse Premium)
Some parts of the Service are available only with a paid Subscription. The extended functionality is accessible inside the App or Bot, and solely for Users with an active and paid Subscription. It includes additional property searching filters, a scan of additional property search platforms, and also may include limited access to a beta version functionality of the Service.
Users are charged in advance on a recurring and periodic basis (e.g., daily, weekly, monthly, or annually), depending on the specific Subscription plan they choose at the time of Subscription purchase.
For iOS App Users
Payments are processed through Apple's In-App Purchase system. Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your Apple ID Account Settings after purchase.
For Android App Users (Google Play)
Payments are processed through Google Play's billing system. Payment will be charged to your Google Play account at the confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions at any time in the Subscriptions section of the Google Play Store after purchase.
For Telegram Bot Users
Payments are processed and handled by Stripe (our payment service provider).
Subscription Cancellations and Refunds
For iOS App Users
The User can cancel the renewal of their Subscription through their Apple ID Account Settings. Please note that refunds are subject to Apple's standard refund policy, and users will retain access to the Service until the expiration of their current Subscription period.
For Android App Users (Google Play)
The User can cancel the renewal of their Subscription at any time through the Subscriptions section of the Google Play Store. Refunds are subject to Google Play's refund policy: within 48 hours of purchase you may be able to request a refund directly through Google Play; after that period, please contact us at [email protected] and we will handle refund requests in accordance with Google Play's policies and applicable law. Users will retain access to the Service until the expiration of their current Subscription period.
For Telegram Bot Users
The User can cancel the renewal of their Subscription either through our Bot or by reaching out to the Service Provider via their Telegram account. Upon cancellation, the User will retain access to the Service until the expiration of their current Subscription period. No prorated refunds are provided for the remaining period after cancellation.
EU Right of Withdrawal: In accordance with the EU Consumer Rights Directive, Users in the European Union have the right to withdraw from their Subscription within 14 days of purchase without giving any reason. To exercise this right, contact us at [email protected] within 14 days of your initial purchase. Refunds will be processed using the same payment method used for the original transaction.
Subscription Fee Changes
The Service Provider, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.
The Service Provider will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.
Free Trial
The Service Provider may offer a Subscription that includes a Free Trial for a limited period of time at its sole discretion.
During the Free Trial, you will have full access to the Subscription's features. The Free Trial will automatically expire at the end of the specified period. Unless you subscribe to a paid plan before the end of the Free Trial, your Subscription will automatically be downgraded to our free plan, which may offer limited features compared to the paid Subscription.
For iOS App Users
Payment will be charged to your Apple ID account unless you cancel at least 24 hours before the end of the free trial period.
For Android App Users (Google Play)
Payment will be charged to your Google Play account unless you cancel before the end of the free trial period. You can cancel at any time through the Subscriptions section of the Google Play Store.
The Service Provider reserves the right, at any time and without notice, to modify the terms and conditions of the Free Trial offer or to cancel the Free Trial offer.
Links to Other Websites
Our service may include links to third-party websites, including but not limited to links to specific rental property ads. We want to emphasize that we have no control over these websites' content, privacy policies, or practices. Therefore, we disclaim any responsibility or liability for the materials, information, products, or services displayed or offered on these third-party websites. You acknowledge and agree that your use of such links is solely at your own risk, and we encourage you to review the terms and privacy policies of any third-party websites you visit through our service.
No Affiliation with Listing Sources
The Service is an independent listing aggregation service. We collect and index rental property advertisements published on third-party websites and platforms, and we direct Users to the original source of each advertisement.
We are not affiliated with, endorsed by, sponsored by, or acting as an agent or partner of any third-party platform, agency, landlord, or advertiser whose advertisements appear in the Service, unless expressly stated in writing. Names, logos, and trademarks of third parties displayed in the Service belong to their respective owners and are used solely to identify the original source of an advertisement; their display does not imply any partnership or endorsement.
We do not create, own, control, verify, or guarantee any third-party advertisement, and we make no representation as to the accuracy, availability, legality, or legitimacy of any advertisement or of the persons behind it. Any inquiry, application, or transaction relating to an advertisement is solely between the User and the relevant source or advertiser, at the User's own risk.
Data Protection and Privacy
Users are informed that the personal data collected may undergo data processing in compliance with relevant data protection laws and regulations. For comprehensive information regarding the usage of your personal data and your associated rights, we advise you to review our Privacy Policy.
Termination
The Service Provider reserves the right to terminate a User's access to the Service or forcibly stop their Subscription for any reason, including but not limited to a violation of these Terms of Service. In cases of termination, the Service Provider will make reasonable efforts to notify the User, provided that the User has left open contact information.
Platform Integrity
Users are strictly prohibited from taking any actions that could potentially harm, disrupt, or compromise the integrity, functionality, or performance of the Service. These actions encompass but are not limited to, attempting unauthorized access to the Service or its systems, utilizing automated means to access or employ the Service, uploading or transmitting malicious software or viruses, or interfering with the proper functioning of the Service.
Lawful Conduct
Users are required to use the Service in strict accordance with all applicable laws, regulations, and rules. Usage of the Service for any unlawful, fraudulent, or harmful activities, including but not limited to infringement of intellectual property rights, harassment, defamation, or invasion of privacy, is strictly prohibited.
Intellectual Property
The Service Provider and its licensors retain exclusive rights to all trademarks, logos, and other media and materials associated with the Service. Users are strictly prohibited from using any of the Service Provider's intellectual property without explicit permission.
Indemnification, Warranty Exclusion, and Liability
The Service is provided 'as is.' Consequently, the Service Provider does not offer you any guarantee concerning it, and in particular concerning: The conformity of our Service to your expectations; The absence of interruption, errors, security breaches, or infringement of the rights of third parties in the operation of the Service; The accuracy and reliability of information obtained through the use of our Service.
More generally, you acknowledge that the Internet and any telematic network used for data transmission may involve risks related to the lack of protection of certain data against possible misuse and risks of contamination by viruses. Also, the Service Provider cannot be held responsible for the loss or alteration of data, or for the loss of opportunity or time. In any event, our liability is limited to direct material damages to the exclusion of any indirect damages of any kind.
We further reserve the right, to the extent permitted by law, to modify, suspend, discontinue, or limit the availability of all or any part of our Service for business and operational reasons at any time without notice.
Users' Feedback
By providing any feedback, ideas, suggestions, or other information ("Feedback") to us regarding our Service, you grant us an unrestricted, irrevocable, royalty-free, perpetual, and worldwide license to use, modify, adapt, publish, translate, create derivative works from, distribute, and display such Feedback in any form, media, or technology, without acknowledgment of you as the source or author and without any obligation to compensate you. You expressly waive any claims to royalties or any other compensation arising from our use of the Feedback. This Feedback may be used for any purpose, including but not limited to product development, enhancements, or marketing, without any limitations or restrictions.
Applicable Laws and Jurisdiction
In case of any dispute or disagreement related to these conditions, the parties agree to abide by Dutch law and submit exclusively to the jurisdiction of the courts in the Netherlands. They waive any rights to seek resolution in other jurisdictions.
Disputes Resolution
If you have any concerns or disputes about the Service, you agree to initially attempt to resolve the matter informally by reaching out to the Service Provider via email at [email protected].
Modification of these TOS
We reserve the right to update or modify these TOS at any time. Any changes will be effective immediately upon being posted on our website. It is your responsibility to regularly check our website for updates to these Terms of Service. Your continued use of our service after the posting of any changes constitutes your acceptance of those changes. If you do not agree to any modifications, you must stop using our service.
Additional Terms for iOS App Users (Apple App Store)
For users who download the App through the Apple App Store, the following additional terms apply:
1. Acknowledgement
You and AnyHouse NL acknowledge that this EULA is concluded between you and AnyHouse NL only, and not with Apple, and AnyHouse NL, not Apple, is solely responsible for the App and its content. This EULA does not provide for usage rules for the App that conflict with the Apple Media Services Terms and Conditions.
2. Scope of License
The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
3. Maintenance and Support
AnyHouse NL is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA, or as required under applicable law. You and AnyHouse NL acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. Warranty
AnyHouse NL is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be AnyHouse NL's sole responsibility.
5. Product Claims
You and AnyHouse NL acknowledge that AnyHouse NL, not Apple, is responsible for addressing any claims of yours or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual Property Rights
You and AnyHouse NL acknowledge that, in the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, AnyHouse NL, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Third Party Terms of Agreement
You must comply with applicable third party terms of agreement when using the App, including but not limited to your wireless data service agreement.
9. Third Party Beneficiary
You and AnyHouse NL acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
